Daria Zhdan-Pushkina

Daria’s main area of expertise is providing counselling on various issues of commercial law, including insurance and transport law, compliance with the law on personal data by personal data operators. Daria provides legal services on issues related to the turnover of real estate (buildings and land), the fulfillment of loan obligations, and enforcement of pledges. Daria also specializes in resolving commercial disputes and disputes with state authorities.

Daria has had placements with companies such as Simmons & Simmons (London), Quadrant Chambers (London), the Moscow Reinsurance Company (Moscow).

Prior to joining Redstone Chambers, Daria worked in the leading law firms in Moscow, Russia and was a partner of the law firm Zhdan-Pushkina and Partners.

In 2007, Daria participated in the preparation of a national research project for the Ministry of Economic Development of the Russian Federation. She has over 30 scientific publications on insurance and transportation law.

Daria is regularly appointed as an arbitrator in commercial disputes. She is a member of the following organizations: London Maritime Arbitration Association, German Maritime Arbitration Association, Japan Commercial Arbitration Association, Young International Arbitration Group Association; Daria is recommended by the Russian Arbitration Center as a specialist in resolving commercial disputes and as a mediator.  

Representative Matters

• Drafting standard clauses (wordings) of the reinsurance contract for a reinsurance company and commenting upon the Russian practice of applying of those contract provisions;

• Representing a shipowner in a litigation on recovery of insurance indemnity related to the grounding of an oil tanker; the insurer refusing to pay part of the costs for repairing a tanker; drafting a letter before action to the insurer, taking part in the negotiations between the parties; compelling the insurer to pay the entire insurance compensation;

• Analyzing insurance coverage of an air carrier's liability and aircraft; amending contract of comprehensive insurance of the carrier’s property and liability;

• Participating in settlement of losses relating to damage to sea port facilities;

• Advising on terms of air law and insurance contract with regard to compensation to the injured party for the loss of an aircraft; providing client with a legal opinion on the terms of air law and on the grounds of recovery of damages;

• Analyzing on Russian legislation on operation and registration of vessels in Russia for an international law firm; comparing registrations in the Bareboat Charter Registry and the Russian International Registry of Vessels; providing client with a comprehensive legal opinion on the issues of operation and registration of ships in Russia;

• Releasing a vessel from arrest outside Russia through a network of correspondents, negotiating with creditors; drafting and executing settlement agreement on behalf of the client;

• Representing interests of a bank in several litigations against guarantors of the loan liabilities; arranging enforcement proceedings;

• Representing interests of a pharmaceutical company in a dispute with the state authorities relating to compliance with personal data legislation;

• Representing interests of an international telecommunication company in dealing with its customers in Russia (compliance, contracts, and negotiations).
